The IRS utilizes a tax lien to let the whole world know that you need to pay tax debt. Do you have tax debt? Have you been served with a Notice of Federal Tax Lien? A Notice of Federal Tax Lien states that if you do not pay your tax bill by the specific deadline, the IRS will file notice of your tax debt in public records offices in the counties you live, work, and own properties in.

The IRS is supposed to send you a notice prior to the lien being recorded. Before the lien notice is sent to the public records office, you are given the chance to figure out a settlement or pay the IRS. Ultimately, the best choice is to avoid a lien.

You also have the right to a hearing. You will be allowed to contest the validity of the lien at that time. You may then appeal to a federal district court or to the U.S. Tax Court if the hearing was not successful.

Getting a Tax Lien Released

  • Declare bankruptcy
  • The IRS accepts an Offer in Compromise
  • Statute of limitations expires (after ten years)

Each lien filed against you will have a Certificate of Release of Lien and you will get it from the IRS within 30 days. You can also request a certificate from the Chief of Special Procedures in the office where the lien was filed. Clearing Your Credit

You'll need to obtain your credit report from the credit reporting agencies. Your credit history should be updated. Have them check the public records or contact the IRS if not. You may also mail the agencies copies of the certificate. Take note that the tax lien might not be removed from your credit records for as long as 10 years.
